Contest Rules

The Contest is administered on behalf of Ultima Foods Inc (the “Contest Organizers”) by Match Marketing and Elite Digital Inc. (the “Contest Administrators”) The IÖGO Win $100 a Day Contest runs online from July 24, 2017, at 12:01 a.m. to October 15, 2017, at 5:00 PM ET (the “Contest Period”).

    ELIGIBILITY

  1. The Contest is open to residents of Canada who have reached the age of majority in their province or territory of residence. Employees, representatives and mandataries of the Contest Organizers or Contest Administrators, of any company, corporation, trust or other legal entity controlled by or affiliated with them, their advertising and promotional agencies, suppliers of prizes, material and services related to this Contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, representatives and mandataries are domiciled, are not eligible. Cookies must be accepted to enter.
  2. HOW TO ENTER

    No purchase necessary.

  3. To enter, purchase at least one (1) IÖGO product in the same transaction during the Contest Period. Keep your receipt as proof of purchase and follow the steps below:
    • Visit IOGO100.ca
    • Upload a photo of your receipt to the link and provide your full name, province, email address, phone number (optional) and confirm that you have read, understood and accept these Rules. If you are not already a subscriber, you must then register for the IÖGO newsletter to enter the contest. You may unsubscribe at any time.
    For each IÖGO product on a unique receipt correctly uploaded with the required information, you will receive one (1) entry into the draw.

    Notwithstanding the above, for every 3 (three) IÖGO Nanö products purchased on the same receipt at the below listed retailers during the bonus time period specified, you will receive thirty (30) entries into the draw instead of 3:

    All Federated Co-operative Stores during the following bonus time period : September 11, 2017 – October 8, 2017.

    All Grand Prize contest entries must be received by 5:00 PM ET on October 15, 2017. With the exception of the first day which starts at 12:01 AM ET and the last day which ends at 5:00 PM ET, a “day” begins at 12:00:00 AM ET and ends at 11:59:59 PM ET.

    All entries must be received and recorded within the Contest Period. The Contest Administrators’ computer is the official timekeeping device for this Contest.

    In the event of a dispute over the identity of an entrant, the entry will be considered made by the natural person who is assigned the email address by the email service provider.

    Max 6 messages per month will be sent by the Contest Administrator. Text “stop” to unsubscribe at any time to opt-out of future text messages.
  4. To enter the Contest without a purchase, legibly write an original handwritten letter of at least fifty (50) words explaining why you would like to win a prize, along with your last name, first name, complete address including postal code, telephone number including area code and email address (the “No Purchase Entry Letter”). You must sign and mail the letter with sufficient postage to: IÖGO Win $100 a Day Contest, 5511 Steeles Ave West, Suite 200, Toronto Ontario, M9L 1S7 no later than October 15 2017, postmark bearing proof thereof; otherwise, the No Purchase Entry Letter will be null and void. After the No Purchase Entry Letter is received and validated, you will receive an entry for each valid letter. Each original handwritten letter may only be used once to request a no purchase entry and must be sent in a separate envelope with sufficient postage.

    To be eligible for the Grand Prize draw, No Purchase Entry Letters must be received at the above address no later than 5 p.m., October 22, 2017.

    To be eligible for the last Secondary Prize draw, No Purchase Entry Letters must be received at the above address no later than 5 p.m., October 15, 2017.

    Refer to Section 11 below for specific draw dates and availability of prizes.
  5. Bonus No Purchase Necessary Entry: Receive thirty (30) entries into the draw instead of just one when your No Purchase Entry Letter: 1) includes, after the minimum fifty (50) word text, mention of five (5) IÖGO Nanö UPC Codes; and 2) the envelope in which it is submitted is postmarked with a date within the following bonus time period: September 11 , 2017 – October 8, 2017. UPC Codes can be found on packaging in stores. Requirements for the handwritten letter are stated in section 3.
  6. Limits. Entrant must comply with the following limits or they may be disqualified:

    Each purchase receipt must be used only once;

    When an entrant has more than one email address, the entrant must only use one (1).
  7. PRIZES TO BE WON

  8. GRAND PRIZE: There is a total of one (1) “Grand Prize” available to be won. The Grand Prize consists of CAD $36,500 (thirty-six thousand five-hundred Canadian dollars) awarded in twelve (12) equal monthly installments payable by electronic funds transfer, Interac e-Transfer® or cheque starting in the month the winner completes the claim process as outlined in Section 9.

    The Grand Prize must be accepted as awarded, cannot be substituted, transferred, or exchanged, except at the sole and absolute discretion of the Contest Organizers, who reserve the right for any reason to award or substitute the Grand Prize, or part thereof, of equal or greater value.

    The Grand Prize will be payable by electronic funds transfer or cheque as determined by the Contest Administrators. It is the Grand Prize winner’s responsibility to ensure that the Contest Administrators are informed of any change to banking information, contact information and/or address information.

    The winner of the Grand Prize is responsible for any taxes or reporting requirements, as applicable. If the Grand Prize winner becomes unable to accept future monthly installments and the issue cannot be rectified within 60 days, all future payments will be forfeited.

    The Contest Administrators and Contest Organizers are not responsible for any failure to properly deposit funds into the winner’s account.
  9. SECONDARY PRIZES: There are a total of thirty (30) “Secondary Prizes” to be won. Each Secondary Prize consists of CAD $100 (one-hundred Canadian dollars).

    The Secondary Prize must be accepted as awarded, cannot be substituted, transferred, or exchanged, except at the sole and absolute discretion of the Contest Organizers, who reserve the right for any reason to award or substitute the Secondary Prize, or part thereof, of equal or greater value.

    The Secondary Prize will be payable by electronic funds transfer, Interac e-Transfer® or cheque as determined by the Contest Administrators.

    The winner of a Secondary Prize is responsible for any taxes or reporting requirements, as applicable. If the Secondary Prize winner is unable to accept the prize, then it will be forfeited.

    The Contest Administrators and Contest Organizers are not responsible for any failure to properly deposit funds into a Secondary Prize winner’s account.
  10. Odds of winning the Grand Prize or Secondary Prize depend on the total number of eligible entries received.
  11. DRAW and CLAIMING OF GRAND PRIZE

  12. On October 23, 2017, at 12:00 PM ET, at the office of the Contest Administrators in charge of the Contest in Toronto, a random draw to select one (1) Grand Prize winner from all eligible entries received will take place. Secondary Prize winners are eligible for the Grand Prize draw.
  13. The potential winner will be sent an email by the Contest Administrators requesting a valid phone number they can be reached at. The potential winner must respond to that email within three (3) business days.
    a.
    The potential winner will be required to correctly answer a mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise, at a time to be mutually agreed upon; and
    b.
    The potential winner must accept the terms of a Declaration of Compliance and Release (the “Release”), which confirms compliance with these Rules and releases the Contest Organizers and Contest Administrators from all liability with respect to the entrant’s participation in this Contest and the awarding, use and misuse of the Prize.
    c.
    The potential winner will be required to furnish proof of identification that may include a driver’s license or other form of picture identification as part of the verification process.
    d.
    The potential winner will be required to supply valid mailing address information.
    e.
    The potential winner will be required to supply the Contest Administrators with a valid direct deposit form for their bank account from a recognized Canadian financial institution. If the potential winner does not have the ability to accept electronic fund transfers then the Contest Administrators can mail them a cheque.
    f.
    The potential winner must return the completed Release form to the Contest Administrators within five (5) business days after being sent by the Contest Administrators. Within three (3) business days after the release form has been verified by the Contest Administrators and confirmed via a phone call or email to the potential winner, the potential winner must supply the information as prescribed in section 10 (c), (d) et (e).
    g.
    If a potential winner is found to be ineligible, declines to accept the Grand Prize, cannot be located or does not respond to or comply with the above requirements, the potential winner will be disqualified and will forfeit the Grand Prize, and, at the Contest Organizers’ discretion, an alternate entrant may be selected as eligible to win in accordance with these Rules. The Contest Organizers or Contest Administrators will not be responsible for failed attempts to notify any potential winner.
  14. DRAW and CLAIMING OF SECONDARY PRIZE

  15. Beginning on August 7, 2017 and occurring on every other Monday through to October 16, 2017 at 11:00 AM ET, at the office of the Contest Administrators in charge of the Contest in Toronto, a random draw to select five (5) Secondary Prize winners from all eligible entries received up to 11:59:59 PM ET the day before (except for the last draw where entries must be received no later than 5 P.M. on October 15th, 2017) will be conducted on a bi-weekly basis.

  16. In the event that there are fewer eligible entries on any random draw date as prescribed in section 11 than the number of Secondary Prizes to be awarded, the draws will be conducted only to the extent possible to select up to the maximum potential winners under these Rules.
  17. The potential winner will be sent an email by the Contest Administrators requesting a valid phone number they can be reached at. The potential winner must respond to that email within three (3) business days.
    a.
    The potential winner will be required to correctly answer a mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise, at a time to be mutually agreed upon; and
    b.
    The potential winner must accept the terms of a Declaration of Compliance and Release (the “Release”), which confirms compliance with these Rules and releases the Contest Organizers and Contest Administrators from all liability with respect to the entrant’s participation in this Contest and the awarding, use and misuse of the Prize.     e.
    The potential winner will be required to supply the Contest Administrators with a valid email address that may be used to receive an Interac e-Transfer®. If the potential winner does not have the ability to accept an Interact e-Transfer® then the Contest Administrators can mail them a cheque.
    f.
    The potential winner must return the completed Release form to the Contest Administrators within five (5) business days after being sent by the Contest Administrators. Within three (3) business days after the release form has been verified by the Contest Administrators and confirmed via a phone call or email to the potential winner, the potential winner must supply the information as prescribed in section 13 (c), (d) and (e).
  18. If a potential winner is found to be ineligible, declines to accept the Secondary Prize, cannot be located or does not respond to or comply with the above requirements, the potential winner will be disqualified and will forfeit the Secondary Prize, and, at the Contest Organizers’ discretion, an alternate entrant may be selected as eligible to win in accordance with these Rules. The Contest Organizers or Contest Administrators will not be responsible for failed attempts to notify any potential winner.
  19. GENERAL CONDITIONS

  20. Verification. Entry Forms, receipts and No Purchase Entry Letters are subject to verification by the Contest Organizers. Any document that is, as the case may be, incomplete, illegible, manually or mechanically reproduced, mutilated, fraudulent, obtained from an unauthorized source, received or submitted late, bearing an invalid email address or phone number, not bearing the correct answer to the mathematical skill–testing question or otherwise noncompliant shall be rejected and will not entitle to an entry or to a prize, as the case may be.
  21. Disqualification. The Contest Organizers reserve the right to disqualify a person or to cancel one or several entries of a person who enters or tries to enter this Contest by using methods that do not comply with these Contest Rules or that are unfair to other entrants (e.g., entries exceeding the authorized limit). Such a person may be reported to the appropriate legal authorities.
  22. Conduct of the Contest. Any attempt to sabotage the legitimate conduct of this Contest constitutes a violation of civil and criminal laws. Should there be any such attempts, the Contest Organizers reserve the right to reject the entrant’s entries and obtain legal or equitable relief under applicable laws.
  23. Acceptance of prize. Prizes must be accepted as described in these Contest Rules and may not, in any case, be in whole or in part transferred to another person, replaced by another prize or exchanged for cash.
  24. Liability limit: use of the prize. By entering the Contest, any entrant releases and holds harmless the Contest Organizers and Contest Administrators, any company, corporation, trust or other legal entity controlled by or affiliated with them, their advertising and promotional agencies, their employees, representatives and mandataries (the “Released Parties”) from and against any damage resulting from the acceptance or use of the prize.
  25. Liability limit: prize supplier. Any entrant selected for a prize acknowledges that upon awarding of the prize, the obligations related to it become the responsibility of the providers of services and goods related to the prize.
  26. Liability limit: conduct of the Contest. The Released Parties disclaim all liability for any of the following that may limit or prevent any entrant from entering the Contest or reading the Contest rules: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The Released Parties also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page or software or by the transmission of any information related to participation in the Contest.
  27. Website. The Contest Organizers and Contest Administrators do not warrant that access to or use of the Contest Website or any related website will be uninterrupted during the Contest Period or error-free.
  28. Contest modification. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the Contest as provided in these Contest Rules.
  29. Termination of participation in the Contest. In the event that participation in the Contest must be terminated in whole or in part before the closing date provided in these Contest Rules, for any reason whatsoever, the Contest Organizers may, at their sole discretion, proceed with the draw from among the entries duly received and registered up to the date of the event ending participation in the Contest.
  30. Prize limit. In no event shall the Contest Organizers or Contest Administrators be required to award more prizes than indicated in these Contest Rules or to award a prize otherwise than in compliance with these Contest Rules.
  31. Liability limit: participation in the Contest. Persons who enter or try to enter this Contest release the Released Parties from any liability for damage these said persons may incur as a result of their entry or their attempt to enter the Contest.
  32. Authorization. By entering this Contest, the entrant selected for a prize authorizes the Contest Organizers and their representatives to use, if required, his/her name, photo, likeness, voice, place of residence and/or statement regarding the prize for publicity purposes, without any form of compensation.
  33. Communication with entrants. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in these Contest Rules or at the Contest Organizers’ or Contest Administrators’ initiative.
  34. Personal information. Entrants’ personal information collected for the purpose of the Contest will only be used to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants unless they have otherwise agreed to receive such communications.
  35. Property. Entry Forms, receipts and No Purchase Entry Letters are the property of the Contest Organizers and shall not in any case be returned to entrants.
  36. Entrant identification. For the purposes of these Contest Rules and subject to what is provided for in section 2 (ii) in case of dispute, the entrant is the person whose name appears on the Entry Form, and it is to this person that the prize will be awarded if he/she is selected and declared a winner.
  37. Contest Organizers’ decision. Subject to what is otherwise provided in these Rules, any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal. Contest Organizer reserves the right to substitute prizing if said prize becomes unavailable for an alternate of equal value.
  38. Unenforceability. If a section of these Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
  39. Litigation. For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.
  40. Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and the Contest Organizers or Contest Administrators in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Quebec without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Quebec.
